As an AI engineer, you are no longer just writing code in a vacuum. You are writing code in a Legal Jurisdiction.

The EU AI Act (passed in 2024 and fully active by 2026) is the first "Comprehensive Law" on AI in the world. Much like the GDPR changed how we handle cookies and privacy, the AI Act changes how we must handle fine-tuning and deployment. If your fine-tuned model is used by a single user in Europe, you must comply with these rules.

In this lesson, we will look at the global "Rules of the Road" for professional fine-tuning.


1. The EU AI Act: Risk Categories

The EU Act doesn't treat all AI the same. It uses a "Risk-Based Approach":

  • Unacceptable Risk: (Banned) e.g., Social credit scoring or mass surveillance.
  • High Risk: (Strict Rules) e.g., Medical AI (Module 17), HR hiring bots, or banking AI. These require "Third Party Audits."
  • Limited Risk: (Transparency Rules) e.g., Chatbots. You must tell the user they are talking to an AI.
  • Minimal Risk: e.g., Spam filters or AI in video games. No major rules.

2. Transparency Requirements for Fine-Tuned Models

Under the EU AI Act, you have a "Duty of Transparency."

  • If your fine-tuned model generates text that looks "human," you must disclose that it is machine-generated.
  • Deepfakes: If you fine-tune an AI to mimic a specific person's voice or writing style, the transparency rules are even stricter.

3. The US Executive Order on AI

In the US, there is no single "Fine-Tuning Law" yet, but there is a powerful Executive Order.

  • Safety Testing: If your model is powerful enough (usually measured in terms of training compute), you must share the results of your "Red Teaming" (Module 12) with the government.
  • Standardization: NIST (National Institute of Standards and Technology) is creating a framework for AI safety that will likely become "Common Law" for all developers.

4. Why "Open Source" is Different

One major battle in the EU AI Act was about Open Source models (Llama, Mistral).

  • The good news: Most open-source models published under a free license are exempt from many of the strictest rules unless they are used in a "High Risk" application.
  • The bad news: If you fine-tune an open-source model and use it for a bank, you are now responsible for the final model's compliance, not the original creator!
