Regulations and the EU AI Act

AI is no longer the "Wild West." Major governments are introducing strict legal frameworks, most notably the EU AI Act. If you are building agents for a global audience, your system must comply with these laws or face astronomical fines (up to 7% of global turnover).

In this lesson, we will simplify the "Wall of Text" of AI regulation into actionable engineering checklists.


1. The Risk-Based Hierarchy

The EU AI Act classifies AI systems based on their risk to humans:

  1. Unacceptable Risk: (BANNED). Social scoring, real-time facial recognition in public spaces, or manipulative behavioral agents.
  2. High Risk: Agents in HR, Education, Healthcare, or Finance.
    • Requirement: Strict auditing, human-in-the-loop, and robust data logging.
  3. Limited Risk (Chatbots): Standard service agents.
    • Requirement: Transparency. The user must know they are talking to an AI (The "I am an AI" disclosure).

2. The Disclosure Requirement

If your agent is "Persuasive"—meaning it generates images, video, or deep text that could be mistaken for a human—it must be Watermarked.

Engineering Rule: Your UI must include a permanent tag: "Generated by AI" or a digital watermark in the metadata of the ResponseObject.


3. Human-in-the-Loop (Legal Necessity)

For "High Risk" systems (like an agent that approves a mortgage), the agent CANNOT make the final decision autonomously.

  • The Law: A human must be able to review the reasoning and "Overrule" the AI.
  • The Code: You must use Interrupts (Module 5.3) as a legal safety barrier.

4. Quality Management Systems (QMS)

If you build a medical agent, you must maintain a "Quality Log."

  • You must record every time the agent's logic was updated.
  • You must record every "Safety Incident" (e.g., the agent gave wrong medical advice).
  • This is where your LangSmith Traces (Module 16.1) become legal documents.

5. The "Copyright" Transparency

Regulations now require developers to disclose if their model was trained on "Copyrighted Material."

  • Action: Use models that have clear "Training Transparency" reports.
  • Strategy: If you are worried about legal liability, use Local Models (Module 12) where you control the training data or fine-tuning process.
